Please read these Terms carefully and is mandatory to accept all Terms in order to use the Software. By visiting our website and accessing all the software applications, content, tools, features, functions and solutions (collectively termed as “SwiftCacheLite“ or “Software”) provided here, you understand and agree to accept and adhere to the terms and conditions as stated in our Terms of Use, User Agreement and Privacy Policy (“Terms”).“You” applies to being both a ‘Visitor’ (visiting our website) and/or a ‘User’ (customer who registered an account). “We” applies to “SwiftCache Lite” and “SwiftServe”.

1) No Responsibility for Errors or Other Inaccuracies
SwiftServe is not responsible for typographical errors or other inaccuracies in the content provided on the SwiftServe website. SwiftServe intends for the information contained in the SwiftServe website to be accurate and reliable. However, errors may occasionally occur. Therefore, all information and materials are provided “AS IS” without any warranty of any kind. SWIFTSERVE DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, REGARDING ANY MATTER WHATSOEVER RELATING TO OR REFERENCED BY THE SWIFTSERVE WEBSITE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT. SwiftServe reserves the right to modify the product and information contained in the SwiftServe website without notifying current or prospective customers. IN NO EVENT WILL SWIFTSERVE BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF, OR PAYMENTS BASED ON, THE INFORMATION CONTAINED IN THE SWIFTSERVE WEBSITE.

2) Links to Other Websites
The SwiftServe website contains links to third-party websites that are not under the control of SwiftServe and SwiftServe is not responsible for the content on any linked site. If you access a third-party website from the SwiftServe website, then you do so at your own risk. SwiftServe provides these links only as a convenience and the inclusion of any link does not imply that SwiftServe endorses or accepts any responsibility for the content on third-party sites.

3) Treatment of Feedback & Responses Provided to SwiftServe
Any comments or materials sent to SwiftServe, including feedback data, such as questions, comments, suggestions and any other response shall be deemed to be non-confidential. SwiftServe shall have no obligation of any kind with respect to such response and SwiftServe shall be free to use, reproduce, distribute and publicly display such comments and materials without limitation. SwiftServe shall also be free to use any ideas, concepts, know-how or techniques contained in such response for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products incorporating such ideas, concepts or techniques.

4) Software Available on SwiftServe Web Site
Any software that is made available to download or use from the SwiftServe website (“Software”) is the copyrighted work of SwiftServe Pte Ltd and/or its licensors. Use of the Software is subject to the terms and conditions of the end user license agreement which accompanies or is included with the Software or other applicable license agreement between you (and the entity you represent) and SwiftServe (the ” Agreement”). You must read and accept such License Agreement before you (and the entity you represent) use the Software. Any use, reproduction or distribution of the Software that is not in accordance with the License Agreement is expressly prohibited.


If the Software is used by the United States Government, the Software, including all related documentation, are “Commercial Item(s),” as that term is defined at 48 C.F.R. Section 2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation,” as such terms are used in 48 C.F.R. Section 12.212 or 48 C.F.R. Section 227.7202, as applicable. Consistent with 48 C.F.R. Section 12.212 or 48 C.F.R. Sections 227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation will be licensed to U.S. Government end users (a) only as Commercial Items; and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions of the License Agreement. 5) Use of Content on the SwiftServe Website
Limited Right to Use, Print and Distribute Content: Except as expressly stated otherwise, you are authorized to view, copy, print and distribute the content of the SwiftServe website subject to the following conditions: (i) it is used for informational, non-commercial purposes only; (ii) any copy or portion must include the SwiftServe copyright notice Copyright SwiftServe© 2016″; (iii) no modifications are made; and (iv) SwiftServe reserves the right to revoke such authorization at any time, and any such use shall be discontinued upon written notice from SwiftServe.

6) Third Party Company and Products
Mention of third party companies and products on the SwiftServe website is for informational purposes only and constitutes neither an endorsement nor a recommendation. Except as may be expressly stated otherwise, all third party products must be ordered directly from the vendor, and all licenses and warranties, if any, take place between you and the vendor.

A.Rights and Responsibilities

In order to use our Software, you will be required to provide certain information about yourself (such as identification, contact details, etc) as part of the registration process. You agree that any information you provide will always be truthful, accurate, up to date and legal for use in all countries. SwiftServe will not be held responsible for any inaccuracy or leak of confidentiality of the information given, including that given and recorded for any third party services linked to SwiftServe.

Software provided by SwiftServe is to be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any local or international law is prohibited.

SwiftServe has the right at its sole discretion to investigate you, suspend and/or terminate your account and Licensing to you where considered inappropriate and contradict the User Agreement and other terms stated herein without prior notice. We are not responsible for any delay or failure in removing such content.

You agree to indemnify SwiftServe and its affiliates from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of this User Agreement and terms stated herein. We reserve the right to be entitled to indemnification under User Agreement and terms stated herein. You shall provide us with cooperation as is requested.

  1. Account Setup, Termination and Billing

Upon confirmation and payment of your order for each Software License, SwiftServe will process your order and invoice you for the payment as described below. This is regardless of the time needed by your end to activate software license to your hardware. Our system will automatically generate the invoice when your account is due for renewal. If you wish to terminate any of the software license, you may manage it under your User Admin Portal account. Customer is liable for payment of any outstanding fees.

All payment will be done via Paypal, with either Credit or Debit cards of Visa or MasterCard or American Express.

– 1st payment will be a complete month of payment based on your billing cycle (e.g. For instance you signed up on 5th Jan, your software license will be till 4th Feb.) Immediate payment is required.

– Invoice for the following month will be emailed to customer upon deduction of the monthly recurring fees.

Account and Website

Each Account is entitled to register for multiple Software Licenses. One Software License is allowed to be installed only on one hardware server.

Overdue payment

  • Software License will be suspended on the 2ndday of the new billing cycle month if payment is not received by 1stday of your new billing cycle month.
  • Software License will be terminated on the 15thday of the new billing cycle month if payment is not received by 14th day of the new billing cycle month.

Termination of License

Customer can choose to terminate the software license through the User login portal. License termination will be effective at the end of the billing cycle month upon completion of termination process as explained on the portal.

Customer is be solely responsible for the records and accessibility to the information provided by Software’s Graphic User Interface (GUI) upon completion of termination process, and SwiftServe will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result.

Pricing, Fees and Availability Information
Pricing and availability as set forth in the SwiftServe website are subject to change without notice and may not be available in all countries. The SwiftServe website may contain references to SwiftServe products and programs that have not been announced in your country. These references do not imply that SwiftServe intends to announce or make available such products, solutions or programs in your country. Further, the SwiftServe website may contain references to future planned SwiftServe products. Such products are only planned and may not actually be produced. Any planned ship dates mentioned in reference to such future products are estimated ship dates only and are not guaranteed.

Fees for our SwiftCache Lite Software are stated and payable in US Dollars as described on our website. Our fees may be amended from time to time at our sole discretion. We may increase the fees, in such a case we will notify you 30 days prior to the effective date of the new fees. Please note that SwiftCache Lite is currently unavailable for Iran, North Korea and Syria.

SwiftServe reserves the rights to turn off the service remotely without any advance notice for Iran, North Korea & Syria and no refunds, partial or otherwise will be given.

  1. Refunds and Expiration

All fees are non-refundable unless expressly stated otherwise, or otherwise provided by applicable law. All amounts deposited into account expiry after 365 days from the date of the payment. Further amounts deposited into account do not extend expiration of previous amounts deposited into account.

  1. Ownership

SwiftServe provide access rights of an Account by the information provided in the Account setup. We are not responsible to determine ownership of the Account, and not obligated to resolve any disputes to claiming the ownership or rights. Any actions and help requested to be taken by SwiftServe in such ownership disputes will be subjected to a fee of USD20 for the administrative overhead for the investigative actions, and will be deemed due and payable immediately.

  1. Changes to Terms of Use

SwiftServe may change any of the Terms by posting revised Terms of Use on our Website and/or by sending an email to the last email address given.The new Terms will be effective immediately and apply to any continued or new use of our Software. If you have any questions about our terms, feel free to contact support@conversant.tv.

  1. Privacy Policy

Your privacy is very important to us, which is why SwiftServe has created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. Our Privacy Policy can be accessed here.

  1. Use of the Web Site by Children
    While SwiftServe’s product ad campaigns and marketing materials may be viewed by children, we do not generally target children as customers or solicit data from them. SwiftServe encourages parents and guardians to spend time online with their children and to participate in the interactive activities offered on the sites their children visit. No information should be submitted to, or posted at, SwiftServe’s web site by visitors under 18 years of age without the consent of their parent or guardian.
